Terms of Sale

1. Agreement to Terms

By placing an order with SummitPort Trading LLC ("we," "us," or "our"), you agree to be bound by these Terms of Sale. These terms govern all purchases made through our website. If you do not agree to these terms, do not complete your purchase.

2. Age Verification Requirements

Federal law requires that purchasers meet minimum age requirements for all firearm transactions. By completing a purchase, you certify that you meet the following minimum age requirements:

• Handguns (pistols and revolvers): You must be at least 21 years of age to purchase.
• Long guns (rifles and shotguns): You must be at least 18 years of age to purchase.
• Ammunition and accessories: You must be at least 18 years of age to purchase.

Age will be verified at the point of FFL transfer. Any order placed by an individual who does not meet the applicable age requirement will be cancelled and refunded, less any applicable processing fees.

3. FFL Transfer Requirement

All firearm purchases must be transferred through a federally licensed firearms dealer (FFL). We do not ship firearms directly to buyers. By purchasing a firearm from SummitPort Trading LLC, you agree to:

• Select a licensed FFL dealer in your area during checkout.
• Contact your chosen FFL dealer prior to purchase to confirm they will accept the transfer and to understand any transfer fees they charge.
• Present valid government-issued photo ID and complete ATF Form 4473 at your FFL dealer upon pickup.
• Pass a National Instant Criminal Background Check System (NICS) background check as required by federal law (see Section 5).
• Comply with all state and local laws applicable to the transfer and possession of the firearm.

SummitPort Trading LLC is not responsible for any fees charged by your chosen FFL dealer. Transfer fees are between you and the receiving dealer.

4. No Returns or Refunds on Firearms

ALL FIREARM SALES ARE FINAL. We do not accept returns on firearms under any circumstances, including but not limited to:

• Change of mind or buyer's remorse.
• Local or state laws that restrict the buyer's ability to possess the purchased firearm.
• Failure to pass a background check (see Section 5 for NICS denial process).
• Delays in FFL transfer or dealer availability.

If a firearm arrives defective or damaged in transit, please contact us at ortizyago1@gmail.com within 48 hours of the FFL transfer. We will work with the manufacturer on your behalf for warranty claims. Returns must be processed directly through the manufacturer per their warranty policy.

5. Background Check Requirement

Federal law requires that all firearms transfers be preceded by a NICS background check conducted by the receiving FFL dealer. By placing a firearm order, you acknowledge:

• You are not prohibited from purchasing or possessing a firearm under federal, state, or local law.
• If your NICS background check results in a denial, the transfer will not proceed and the firearm will be returned to us.
• In the event of a NICS denial, you will be refunded the purchase price of the firearm less a $50 restocking and return shipping fee.
• SummitPort Trading LLC is not responsible for NICS delays or denials and cannot influence the outcome of a background check.

6. Buyer Responsibility for Legal Compliance

It is solely the buyer's responsibility to know, understand, and comply with all applicable federal, state, and local laws and ordinances regarding the purchase, transfer, possession, use, and transport of firearms and ammunition. This includes but is not limited to:

• State-specific restrictions on magazine capacity, barrel length, features, or firearm types (e.g., assault weapon laws, handgun rosters).
• Waiting period requirements imposed by state or local law.
• Permit or registration requirements in your jurisdiction.
• Restrictions on the purchase of certain calibers or types of ammunition.
• Safe storage requirements applicable in your jurisdiction.

SummitPort Trading LLC does not guarantee that any product listed on our website is legal for purchase, transfer, or possession in your jurisdiction. It is your obligation to verify legality before placing an order.

7. Disclaimer of Liability

SummitPort Trading LLC is not liable for any violation of local, state, or federal ordinances by the buyer. The buyer assumes full legal and civil responsibility for ensuring that the purchase, transfer, possession, and use of any product purchased from SummitPort Trading LLC is lawful in their jurisdiction.

SummitPort Trading LLC expressly disclaims all liability for:

• Any criminal charges, civil penalties, or forfeitures arising from the buyer's purchase or use of products.
• Any injury, death, or property damage resulting from the misuse or unsafe handling of firearms.
• Any violation of local ordinances, state statutes, or federal regulations by the buyer.

Our maximum liability to you in connection with any order shall be limited to the purchase price paid for the specific product(s) in dispute.

8. Pricing & Availability

All prices are in U.S. dollars and are subject to change without notice. We reserve the right to cancel any order at our discretion, including orders placed at incorrect prices due to system errors. In such cases, you will receive a full refund. Inventory availability is not guaranteed; in the event that a product becomes unavailable after your order is placed, we will notify you and issue a full refund.

9. Governing Law

These Terms of Sale are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Texas.
